Resolution 2016-74 - Acceptance of Offsite Sewer Easement from Oakhall Association, Inc. for Witherspoon subdivision development.

Background

A condition of approval for the Witherspoon subdivision development project included extension of offsite public sewer at two separate locations: one to the west at Aberdeen Drive and one to the south in the Oakhall subdivision's common space (see attached map). In order for the offsite sewer at Oakhall to be installed, the developer, on behalf of the City, was required to obtain a utility easement from the Oakhall homeowner’s association. The Oakhall HOA owns the land to the south where the existing sewer line is located and where the connection will be made. Accordingly, the developer has negotiated the purchase of the easement from the Oakhall HOA.

Given that the sewer line will be a public line, the easement must be in the City's name. If acceptance is authorized, the easement will become the property of the City for future maintenance of the sewer line by the Water Services Department. Upon acceptance, the easement document will be recorded at the Williamson County Register of Deeds office and a copy returned to the Oakhall HOA.

Staff Recommendation

Staff recommends acceptance of the offsite sewer easement as discussed above.

Previous Commission Action

At the October 26, 2015, the Board of Commissioners approved Ordinance 2015-12, rezoning the Witherspoon subdivision property.
